中国:「中西部地区外国企業投資産業優位産業目録」(中西部地方目録)の見直し
China FDI Catalogue
On May 9, 2013, NDRC (the “National Development and Reform Commission”) and MOC (the “Ministry of Commerce”) jointly promulgated the Catalogue of Priority Industries for Foreign Investment in the Central and Western Regions (Amended in 2013) (the “Regional Catalogue”), which came into effect on 10 June 2013. The Regional Catalogue replaces its predecessor issued in 2008, and adds 173 categories to the original list. The Catalogue is organized by province, covering 22 out of the 31 provincial-level administrative regions in Mainland China. According to the “Provisions on Guiding Foreign Investment,” foreign-invested projects included in the Regional Catalogue are entitled to the preferential policies granted for the foreign-invested projects under the encouraged category. The new Regional Catalogue encourages foreign investments in eco-friendly, labor-intensive industries that satisfies environmental protection requirement in central and western regions, with the purpose of promoting resource conservation and comprehensive utilization, improving the service industries standard, taking full advantage of the labor and resources in central and western China and transforming the region’s abundance of resources into economic development advantages in the key industries. The new catalogue also strictly prohibits companies from relocating obsolete projects from the eastern region to the central and western regions. The new Regional Catalogue includes the following key adjustments compared to previous one:- It broadens the encouraged industries. There are approximately 500 entries in the Regional Catalogue now with some 173 new items added into this round of amendments. To attract more foreign investments in inland China, for instance, manufacture of automobiles is introduced in the Regional Catalogue while it is no longer encouraged by the Foreign Investment Industrial Guidance Catalogue (Amended in 2011), a general guideline for foreign investment across the whole country (the “National Catalogue”).
- It optimizes industry orientation. Except traditional manufacturing industries, the new Regional Catalogue added new entries of more modern service sectors, e.g. cloud computing, the Internet of Things, and mobile Internet sectors in Shanxi province, animation creation in Heilongjiang province, and retail and wholesale businesses in Shaanxi province.
- The qualification requirements for investments enjoying preferential policies are further clarified or tightened up. For example, more detailed technological specifications are required to obtain qualification for the encouraged investments in manufacture of automobile parts and components in central and western China.
- The geographical cover of the Regional Catalogue is enlarged. The Regional Catalogue has now also include the whole Hainan province in the central and western region by listing such investment projects fitting the local circumstances and conditions as manufacturing of cruises, deep-water marine engineering equipment, and development, operation and construction of ancillary facilities for ocean and non-reserved rainforest ecotourism projects as the priority industries.
- 奨励業種の幅の拡大:500項目の目録に更に173項目を追加。外資投資を中国内陸に呼び込むために、例えば自動車産業を中西部地方目録2013年版に奨励業種として盛り込んでいるが、中国全地域に及ぶ外商投資産業指導目録2011年版から自動車産業が奨励業種から取り外されている。
- 産業の法構成の適応化:新しい中西部地方目録にはハイテク産業の奨励事項が盛り込まれている。クラウドコンピューティング、インターネット、山西省でのモバイルインターネット部門、黒竜江省でのアニメ産業、陝西省での小売と卸売り産業など。
- 投資事業における優先的政策待遇を受ける際の資格要求の強化。例えば自動車部品の製造にて待遇申し込みの際に部品の仕様詳細明記の規準が厳しくなるなど。
- 地方目録の適用省の拡大:新しい地方目録には海南省も中西部として含まれる。海南省での船製造や深海洋工学機械やその他の海洋製品や設備などの産業が、エコツーリズム産業などに合わせて奨励業種に加えられている。
